What happens to my medical data if I decide not to continue with Everlab?

If you choose to stop using Everlab, we’ll respect your decision and ensure your data is handled in a secure, compliant, and privacy-conscious manner.


What We’ll Do

  • Deactivate your Everlab account

  • Remove internal team access to your health records (only authorised clinical staff will retain access if needed for compliance)

  • Retain a secure copy of your health records on our servers for the required legal period


Why We Must Keep Your Records

As a registered health service provider, Everlab is legally obligated to retain patient medical records—even after you stop using our services.

Victoria & NSW

7 years after your last interaction, or until age 25 if under 18 at the time of care

ACT

7 years under the Health Records (Privacy and Access) Act 1997

New Zealand

10 years under the Health (Retention of Health Information) Regulations 1996

Even if you request deletion, there is no “right to erasure” under Australian privacy laws, and we are required to keep these records for the minimum retention period.


What Happens After the Retention Period?

After the applicable retention period has passed:

  • Your health records will be securely and permanently deleted

  • A record will be kept in our deletion register (as legally required), including:

    • Your name

    • The time period the records covered

    • The date of deletion
